“Customer” refers to any user seeking parking spaces.
“Leaser” refers to any user offering their space for parking.
“Services” refers to the functionalities provided by the application, including searching for parking spaces, leasing spaces, and availing of parking spaces.
3. Acceptance of Terms
By using our application, you agree to these Terms. If you do not agree, please do not use our application.
4. User Accounts
Users must create an account to use the services.
Users must be at least 18 years old to use the application.
Users are responsible for maintaining the confidentiality of their account information, including their username and password.
Users must provide accurate, complete, and current information during registration and update their information if it changes.
5. Use of Services
The application facilitates the search and booking of parking spaces.
Leasers can list their parking spaces, specifying availability, rates, and any relevant restrictions (e.g., size limitations, vehicle types).
Customers can book spaces based on the listed availability, rates, and restrictions.
Users must comply with all applicable laws and regulations while using the services. This includes traffic laws, parking regulations, and any specific terms set by leasers for their spaces.
6. Payment and Fees
Parking charges are based on the time duration selected (hourly, daily, or monthly) as specified by the leaser.
Payment must be made through the application using the provided payment methods. We may charge a transaction fee for using these methods.
In case of any disputes regarding parking fees or payments, you agree to contact us first to attempt a resolution. We will investigate the issue and mediate between the customer and leaser.
All fees are non-refundable unless otherwise stated in the specific parking listing or due to extenuating circumstances determined by us.
7. User Responsibilities
Users must ensure the accuracy and completeness of the information they provide, including vehicle information.
Users must use the services in a lawful manner and in accordance with these Terms.
Users must respect the property of others and the terms set by leasers for their spaces. This includes parking within designated areas and respecting any limitations or restrictions.
Users are responsible for any damage caused to a parking space or surrounding property due to their use of the application or services.
8. Leaser Responsibilities
Leasers must provide accurate and complete information about their parking spaces, including their location, availability, rates, and any restrictions.
Leasers must ensure that the spaces are available for booking as listed.
Leasers must comply with all applicable laws and regulations regarding leasing their parking spaces.
Leasers are responsible for ensuring the safety and security of the parking space and any potential damage to the customer’s vehicle while parked in the space.
9. Limitation of Liability
The application is provided “as is” without warranties of any kind, express or implied.
We are not liable for any damages resulting from the use of the application, including but not limited to, damages caused by technical errors, user misuse, or user-generated content.
We do not guarantee the availability or suitability of any parking spaces listed. Leasers are solely responsible for the accuracy of their listings.
We are not liable for any disputes between customers and leasers arising from parking transactions or the use of parking spaces.
10. Privacy Policy
We are committed to protecting your privacy. Please refer to our Privacy Policy for more details about how we collect, use, and disclose your information.
11. Termination
We reserve the right to terminate or suspend your account for any reason, including but not limited to:
Violation of these Terms
Fraudulent activity
Inactivity for an extended period
You may terminate your account at any time by contacting us. In case of termination, any outstanding charges for parking must be settled before your account is fully closed.
12. Changes to Terms
We may update these Terms from time to time. Your continued use of the application after the revised Terms are posted constitutes your agreement to the changes.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction].
14. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or your use of the application, you and we agree to attempt to resolve the dispute through informal negotiation. These Terms and Conditions (“Terms”) govern the use of the Parkar Spot mobile application (the “Application”) by Parking Owners or Leasers (referred to herein as “You” or “Leaser”). By registering as a Leaser and listing parking spaces on Parkar, you agree to abide by these Terms.
1. Introduction
Parkar Spot is a platform that connects customers seeking parking spaces with owners willing to lease them. By using this platform as a Leaser, you agree to these Terms. If you do not agree, you may not list or lease any spaces through the platform.
2. Definitions
Application: The Parkar Spot mobile app and any associated services.
Leaser: A user who lists and manages parking spaces on Parkar.
Customer: A user who books a parking space through the Application.
Services: The tools and features provided by Parkar to list, search, book, and manage parking spaces.
3. Account and Verification
You must be at least 18 years old to register as a Leaser.
You must create an account via Google Sign-In or OTP login and verify your identity with a valid government-issued ID before listing any parking spaces.
You are responsible for maintaining the confidentiality of your login credentials.
4. Listing Parking Spaces
You may list your parking spaces by providing accurate details such as address, price, availability, vehicle type compatibility, and images.
All listings must reflect real, available parking spaces.
You are responsible for ensuring your space complies with local zoning, legal, and safety regulations.
Fraudulent, duplicate, or misleading listings may result in account termination.
5. Booking and Cancellation Policy
You will receive a booking confirmation once a customer reserves your space through the Application.
If a customer cancels their booking at least one hour before the scheduled start time, they are eligible for a full refund, and you will not receive any payout.
If the customer completes the parking session successfully, you will receive payment after confirmation, minus any applicable platform service fees.
6. Payouts and Payment Processing
All payments are processed through third-party gateways. You agree to their terms and conditions.
Your payout will be made to the payment method or UPI ID registered in your profile.
Payouts may be subject to delay in case of disputes or platform investigations.
7. Responsibilities and Liability
Leaser Responsibilities:
Ensure the parking space is accessible, clean, and secure at the listed times.
Be present or responsive if required during bookings.
Provide assistance to customers in case of location or access issues.
Ensure the safety of vehicles parked in your space.
Maintain a fair cancellation and refund policy, as outlined by Parkar.
Damage and Disputes:
You are liable for any external damages (e.g., scratches, dents, vandalism) that occur while the vehicle is parked in your space.
You are not responsible for interior damage or personal belongings inside the vehicle.
In case of damage due to negligence (e.g., exposed wiring, poor lighting, short-circuits), you may be held accountable and required to compensate or face legal action.
Natural disasters (e.g., floods, earthquakes) do not impose liability on the Leaser.
Customer Misuse:
In case of misuse or damage caused by a customer, you are entitled to compensation. Customers are responsible for intentional damage or misuse of the property.
8. Prohibited Conduct
You may not:
List non-existent or inaccessible parking spaces.
Demand offline payments or circumvent the platform.
Harass or threaten users or misuse their information.
Refuse payout obligations after a completed booking.
9. Platform Role and Limitation of Liability
Parkar is a technology facilitator only, not a parking space provider.
Parkar is not liable for disputes, damages, or legal claims between Leasers and Customers.
The platform may assist with dispute resolution but has no legal responsibility for either party’s obligations.
10. Termination and Suspension
We reserve the right to suspend or terminate your account if:
You violate these Terms.
You post misleading or harmful content.
You engage in fraudulent activity.
You remain inactive for a long period.
Termination may forfeit pending payouts if rules have been breached.
11. Data and Privacy
You agree that your personal data may be collected, used, and shared as described in the Parkar Parking Owner Privacy Policy. You may request access or deletion of your data by contacting our support team.
12. Modifications to Terms
We may modify these Terms from time to time. Changes will be communicated through email or in-app notification. Continued use of the platform after updates constitutes acceptance.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of [Your Jurisdiction, e.g., India].
14. Dispute Resolution
