This privacy policy explains how Parkar (hereinafter referred to as “Service Provider”) collects, uses, and protects the information provided by customers when booking parking spaces through the Parkar platform.

Information Collection and Use

When you book parking through Parkar, we may collect the following information:

  • Your name, email address, and mobile number.
  • Your selected parking location and booking details, including date, time, and duration.
  • Your payment details, including payment method and transaction ID (if applicable).
  • Your device’s location for providing nearby parking options and accurate directions.
  • Any additional preferences or comments you provide during booking.

The information is used solely for processing your booking, ensuring smooth parking experiences, and enhancing the quality of our services.

Third-Party Access

The Service Provider may share necessary booking details with the parking space providers (e.g., parking owner or administrator) to confirm and manage your reservation. These details include your name, booking time, and vehicle details, if provided.

Payment-related data may be processed by third-party payment gateways, which adhere to their respective privacy policies. Links to their privacy policies will be available during the payment process.

Liability for Vehicle Damage

During the parking period, the Service Provider is not responsible for any damage, theft, or loss related to your vehicle. Any such issues are the sole responsibility of the parking space owner or administrator. Customers are encouraged to directly address such matters with the parking provider.

Data Retention Policy

The Service Provider retains booking-related data for record-keeping and customer service purposes for a reasonable period (e.g., one year from the booking date). Customers may request deletion of their booking data by contacting us at support@parkarspot.com.

Security

The Service Provider takes the security of your information seriously and implements technical, administrative, and physical safeguards to protect your data.

Customer Rights

Customers have the right to:

  • Request access to the personal data collected during the booking process.
  • Request correction or deletion of their personal information.
  • Withdraw consent for processing personal data by contacting support@parkarspot.com.

Changes to This Policy

This privacy policy may be updated periodically to reflect changes in our practices or legal requirements. Customers will be notified of significant changes, and the updated policy will be available on the application or website.

These Terms and Conditions (“Terms”) govern the use of the Parkar mobile application (the “Application”) by Parking Owners or Leasers (referred to herein as “You” or “Leaser”). By registering as a Leaser and listing parking spaces on Parkar, you agree to abide by these Terms.


1. Introduction

Parkar is a platform that connects customers seeking parking spaces with owners willing to lease them. By using this platform as a Lessee, you agree to these Terms. If you disagree, you may not list or lease any spaces through the platform.


2. Definitions

  • Application: The Parkar mobile app and any associated services.

  • Leaser: A user who lists and manages parking spaces on Parkar.

  • Customer: A user who books a parking space through the Application.

  • Services: The tools and features provided by Parkar to list, search, book, and manage parking spaces.


3. Account and Verification

  • You must be at least 18 years old to register as a Leaser.

  • You must create an account via Google Sign-In or OTP login and verify your identity with a valid government-issued ID before listing any parking spaces.

  • You are responsible for maintaining the confidentiality of your login credentials.


4. Listing Parking Spaces

  • You may list your parking spaces by providing accurate details such as address, price, availability, vehicle type compatibility, and images.

  • All listings must reflect real, available parking spaces.

  • You are responsible for ensuring your space complies with local zoning, legal, and safety regulations.

  • Fraudulent, duplicate, or misleading listings may result in account termination.


5. Booking and Cancellation Policy

  • You will receive a booking confirmation once a customer reserves your space through the Application.

  • If a customer cancels their booking at least one hour before the scheduled start time, they are eligible for a full refund, and you will not receive any payout.

  • If the customer completes the parking session successfully, you will receive payment after confirmation, minus any applicable platform service fees.


6. Payouts and Payment Processing

  • All payments are processed through third-party gateways. You agree to their terms and conditions.

  • Your payout will be made to the payment method or UPI ID registered in your profile.

  • Payouts may be subject to delay in case of disputes or platform investigations.


7. Responsibilities and Liability

  • Leaser Responsibilities:

    • Ensure the parking space is accessible, clean, and secure at the listed times.

    • Be present or responsive if required during bookings.

    • Provide assistance to customers in case of location or access issues.

    • Ensure the safety of vehicles parked in your space.

    • Maintain a fair cancellation and refund policy, as outlined by Parkar.

  • Damage and Disputes:

    • You are liable for any external damages (e.g., scratches, dents, vandalism) that occur while the vehicle is parked in your space.

    • You are not responsible for interior damage or personal belongings inside the vehicle.

    • In case of damage due to negligence (e.g., exposed wiring, poor lighting, short-circuits), you may be held accountable and required to compensate or face legal action.

    • Natural disasters (e.g., floods, earthquakes) do not impose liability on the Leaser.

  • Customer Misuse:

    • In case of misuse or damage caused by a customer, you are entitled to compensation. Customers are responsible for intentional damage or misuse of the property.


8. Prohibited Conduct

You may not:

  • List non-existent or inaccessible parking spaces.

  • Demand offline payments or circumvent the platform.

  • Harass or threaten users or misuse their information.

  • Refuse payout obligations after a completed booking.


9. Platform Role and Limitation of Liability

  • Parkar is a technology facilitator only, not a parking space provider.

  • Parkar is not liable for disputes, damages, or legal claims between Leasers and Customers.

  • The platform may assist with dispute resolution but has no legal responsibility for either party’s obligations.


10. Termination and Suspension

We reserve the right to suspend or terminate your account if:

  • You violate these Terms.

  • You post misleading or harmful content.

  • You engage in fraudulent activity.

  • You remain inactive for a long period.

Termination may forfeit pending payouts if rules have been breached.


11. Data and Privacy

You agree that your personal data may be collected, used, and shared as described in the Parkar Parking Owner Privacy Policy. You may request access or deletion of your data by contacting our support team.


12. Modifications to Terms

We may modify these Terms from time to time. Changes will be communicated through email or in-app notification. Continued use of the platform after updates constitutes acceptance.


13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of [Your Jurisdiction, e.g., India].


14. Dispute Resolution

Any dispute will first be attempted to be resolved through informal negotiation. If unsuccessful, the matter will be referred to binding arbitration as per applicable local laws or arbitration authority.
